Mississippi Management Services Agreement Guide: Policy 3.02 Conditions and the Peptide Statement

Mississippi's Board will not police the form of a business arrangement if the physician keeps sole discretion over treatment, billing and advertising, no referral inducements are paid and anti-kickback rules are met.

Key Highlights

  • Policy 3.02 conditions the Board's approach on sole physician discretion over treatment and billing, no referral inducements, anti-kickback compliance, patient free choice and physician approval of all ads.
  • A prescribing rule bars a licensee from being influenced by a financial interest in a pharmaceutical firm, pharmacy or supplier.
  • Records remain the property of the licensee in whose facility they are kept, with ten-year retention.
  • The August 2026 joint statement bars research-grade peptides under any circumstances.

How to Price the Management Fee

We found no Mississippi fee-splitting rule or authority on percentage fees. The operative limits are Policy 3.02's rules that billing and fees are left solely to the physician and no consideration is received as an inducement for referrals, so we use a fixed fee for defined services.

What the Practice Must Keep

The physician keeps treatment in their sole and absolute discretion, billing and fee amounts, and approval of all public communications and advertisements, and a named responsible physician appears on all ads. A dispensing physician must register and personally dispense.

Terms to Avoid

Avoid any referral inducement, any influence on treatment, MSO-affiliated pharmacy or supplier arrangements that could influence prescribing, exclusive distributorship and personal branding, and research-grade peptides, which the August 2026 statement says no consent form cures.

Term, Records and Departing Clinicians

The administrative code says records remain the property of the licensee in whose facility they are maintained, with 10-year retention beginning January 1, 2026. Non-competes follow common-law reasonableness, and we do not use them for employed clinicians.

Filings, Notices and Watch Items

We found no Mississippi transaction notice law. Shareholders of a medical professional corporation are physicians only under the Board's policy.

Drafting Checklist

  • Fee: fixed, no referral inducement.
  • Treatment: sole physician discretion.
  • Billing: left to the physician.
  • Advertising: physician approves all.
  • Supplier ties: none that influence prescribing.
  • Peptides: only from permitted sources.

How We Draft It

Patients pay the physician-owned practice, the practice pays the management company a fixed monthly fee under the agreement, and the management company pays MedGrid a fixed monthly retainer for consulting. The management company never practices medicine, and the agreement never moves a clinical decision to it. Our template follows the same flat-fee design in every state, with the state-specific limits below layered on top.

Disclaimer

This article is general educational information, not legal advice. Management agreement rules change and differ by state, and this summary draws on our published state guide, parts of which rest on secondary sources, so have health care counsel in the state review any agreement before you sign.

MedGrid MSO provides management services to independently owned practices; it does not practise medicine and does not direct clinical decisions. Requirements vary by state and by service, and change over time — nothing on this page is legal or medical advice. Talk to us or your own counsel before making a structural decision for your clinic.
