Colorado Telehealth Compliance for Cash-Pay Clinics: The New Registration Route and What It Bars

Colorado created an out-of-state telehealth registration route that took effect in January 2026, but registrants cannot prescribe any controlled substance, which rules out testosterone and ketamine. A compact license is the alternative.

Key Highlights

  • Colorado requires a Colorado license for patients located in Colorado, and a registration route that became operative on January 1, 2026 is available to physicians.
  • Registrants may not prescribe any controlled substance, which bars testosterone and ketamine, and may not open an office or give in-person care.
  • The Medical Board's telemedicine policy says treatment, including a prescription, based solely on an online questionnaire is not an acceptable standard of care.
  • A compact license covers controlled-substance prescribing and is the alternative to registration.

Licensure and the New Registration Route

The Colorado Medical Board's telemedicine policy says the practice of medicine occurs where the patient is, so a Colorado license is required. A statutory registration route, enacted in 2024 and operative January 1, 2026, is available to physicians. The conditions are an unencumbered credential, no limiting, suspending or revoking discipline in the prior five years, a jurisprudence exam if required, an agent for service, financial responsibility, an emergency protocol and a disclosure that the provider has no Colorado location. Registrants may not prescribe any controlled substance and may not open an office or give in-person care. A license through the Interstate Medical Licensure Compact is the alternative and covers controlled-substance prescribing.

Relationship and Evaluation

The Board's policy says the relationship may be formed by telehealth and that an evaluation is required before prescribing. It states that treatment, including issuing a prescription, based solely on an online questionnaire does not constitute an acceptable standard of care. The policy calls itself guidance and defines telehealth to include store-and-forward. A relationship cannot exist if either party's identity is unknown.

Prescribing

Medical marijuana may not be recommended by telehealth. For controlled substances, the registration bar means a telehealth practice built on testosterone or ketamine needs full Colorado licensure or a compact license. A 2026 bill to regulate compounded GLP-1s was postponed indefinitely in May, according to a trade association.

NPs and PAs

Physician assistants practice under collaboration rules that changed in 2023, and advanced practice nurses must complete a 750-hour mentorship before independent practice, according to secondary sources.

Corporate Practice

It is unprofessional conduct in Colorado to practice as a partner, agent or employee of, or in a joint venture with, an unlicensed person, except as a related statute allows, and a secondary summary says lay directors and officers may not control independent medical judgment. We found no Colorado authority specific to telehealth or management companies. A 2026 bill that would have loosened ownership for med-aesthetic corporations was postponed indefinitely in March, so the physician-owned PC with a flat-fee agreement remains the design.
